Abstract


News freedom and the citizen’s right to privacy is our constitution to protect this all objects and rights, both represent different interest demand and the value orientation, News freedom representing the public right of citizens, focus on the protection of citizens’ public interests, but the privacy rights citizens represents citizens own rights, more focused on the citizen’s own individual rights. In actual society, with a media age more and more media began to constantly violation of privacy rights, accompanied by citizens of the legal consciousness of our citizens, continuously improve the privacy rights and news citizens the right to free game formally pulled open heavy curtain.Paper is divided into four parts altogetherThe first part summarizes the basic concept of news invasion of privacy. This part of main there are two parts, the former part is news freedom and privacy introduced the related concepts, including news interview, privacy and interviews with privacy. After the introduction of news freedom is part of the type of invasion of privacy with main forms of expression.The second section discusses the news invasion of privacy emergence mechanism and deep reasons. The generating mechanism of invasion of privacy is mainly right to know and privacy conflict, journalism and privacy of the conflict, is further introduced the infringement of privacy news the legal basis for citizens. The purpose of this part is produced from in-depth research, the reason of the infringement,Also is behind and privacy of interview with citizens’ privacy conflicts between value for counterparts, this paper provides a theoretical support countermeasures article.The third part discusses the legal responsibility of news invasion of privacy. Firstly introduces news invasion of privacy legal responsibility constituents, Mainly divides into the news violation right of privacy behavior the existence, the violation result appearance, to invade the behavior and the violation result has the causal relation, right infringement person’s subjective mistake these four aspects. Then introduces the subject of violation bear legal responsibility, mainly from liability subject, the way the responsibility to introduce the two aspects.The fourth part discusses the infringement of citizens when news legal relief problem of privacy. First from foreign legislation present situation, and then analyzes the current legal provisions to analyses the present situation of domestic and foreign legislation comparison analysis, and put forward its own advantages and disadvantages. Finally, this paper puts forward the emphasis on how to perfect our country related legislation, advice and opinions, this includes the "news dissemination and make the relevant law perfect our privacy law protection, enhance the self-discipline of the news media in proposals. The author hoped that studies through oneself can give in the reality the freedom of the news violation right of privacy question solution to provide one kind of new thought that better causes legal the value to manifest in the protection privacy.
