Abstract

Modern enterprise while promoting the rapid development of society has also become a variety of pollution incidents, environmental incidents caused by the manufacturer. Corporate environmental information disclosure legal system is to follow the basic principles of the national environmental policy and environmental law, legal norms, collectively, adjust the main obligations in accordance with the law of public environmental information behavior specific system consists of a series of legal norms. Emphasis on corporate environmental information disclosure is the current international environment the new trend of the development of information legislation. The United States, the European Union, represented by some countries and regions have established a system of corporate environmental information disclosure system, and actively implement the statutory and effective and objective environmental information disclosure evaluation system and evaluation criteria. Comparison and analysis on domestic and foreign enterprises environmental information disclosure legislation and practice of the legal system, summed up China's problems in practice in corporate environmental information disclosure system of legislation: Legislative scattered, fragmented legal hierarchy than the low; legal system is not complete, specific provisions on corporate environmental information disclosure obligations body, evaluation methods, an open process, open to the public, and means; should open a narrow range, the mandatory disclosure of the information content of and forced open standards and conditions in the actual operation is not practical; important safeguards and remedies are still missing; small number of enterprises of the public environmental information, public information quality is not high; lack of public participation; can not play the advantages of non-governmental environmental organizations. In line with the promotion of China's enterprises, social harmony and economic development and to achieve the purpose of the concept of sustainable development, from the point of view of solving the above problems, combined with China's national conditions, improve our corporate environmental information disclosure legal system should commence in the following areas: First, the Constitution clear right to know or the right to know the status and the Basic Law of Environmental Protection to increase enterprises have responsibility for the content of the protection of the environment; Second, corporate environmental information disclosure of corporate environmental information disclosure regulations by the State Council to establish a basic legal system; in the enactment of specific content should include all aspects of the legislative intent of the principle of openness, the public body, open range, open procedures, responsibilities and remedies; Finally, it should be synchronized establishment and improvement of the public with environmental information relevant supporting measures.
