Abstract


As a way of demonstrating of Judicial identification, is widely used in the course of the proceedings, especially today, with the rapid development of science and technology. In the course of a case.The judge is unable to distinguish only with their own knowledge and experience. If the case has a number of technical and professional issues, judge needs expert knowledge of the judicial appraiser help. Therefore, ability and level of the judicial appraiser not only directly affects and decides the quality of judicial authentication, but also has an important role in the trial of cases. However, at present, China’s judicial expertise areas where is a serious lack of talent and quality uneven situation unable to meet the lawsuit activity need. In order to alleviate this kind of contradiction, some areas have been tried to establish the system about the assistant of judicial appraiser, attracting and training reserve talents for full judicial identification team. In practice, this also produced positive effects.However, the current assistant of judicial appraiser Assistant’s system also have many imperfections. for example, the appointment of the assistant appraiser is broad, and its training method is not reasonable, and so on. We need to study deeply, in order to promote development of the judicial identification healthily and continuously. This is also the author’s intention in writing.This article studies China’s Judicial appraiser Assistant’s system from the following three aspects. The first part is " The basic connotation of the assistant appraiser system ".In this part, the author analyzes assistant appraiser of the character, the assistant appraiser system connotation and the assistant appraiser system value orientation. the author puts forward to build a perfect the assistant appraiser system, which is the inevitable choice to train judicial identification of reserve talents. It is the important way to standard supporting activities of judicial identification, the important measure to strengthen institutions vitality of judicial authentication, and the only way which the successful development of the cause of judicial identification. The second part is "China’s assistant appraiser system current situation and deficiency". The author laies stress on analyzing the China’s assistant appraiser system which has been formulated in some areas. After analyzing,there are three aspects of the problem on current assistant appraiser system. assistant appraiser admittance condition setting is too loose, assistant appraiser training means are unscientific and unreasonable, assistant appraiser of the business environment is not ideal. The third part is "China’s assistant appraiser system perfection". This part is the emphases of the article, also a complete design for assistant appraiser system. A total of thirteen respects is about the main arguments, includes:the assistant appraiser access conditions, training mode, mode of selection, term of office, responsibilities, rights, obligations, profession regulation, supervision and management, examination and evaluation, legal liability, exit mechanism and assistant appraiser system consists.
