Abstract


Eligible for punishment is an ancient penalty, it deprived the offender’s eligibilityfor enjoyment or exercise of certain powers.Compared to the physical punishment ofthe ancient society, it reflects the progress. Compared to the property criminal, it hasits own advantages. Meanwhile, the development and improvement of qualificationspunishment is conducive to the protection of human rights, and it has an importantcontribution to the development of Human Civilization.This article is the historical perspective and the concrete law which to theChinese and Russian qualifications punishment content, proposed the suggestion andthe consummation measure, it may help to our country qualifications punishmentdevelopment, promotes the human rights safeguard development on objective.This article is divided into five parts. The first part is eligible for punishment, isan overview of the general eligibility punishment theory and the value, including it inChina’s development process, the evolution of the names and types of.The second part is about the law of the foreign qualification punishment.Including the provisions of the earliest Roman law, the legal requirements of themajor developed countries and international conventions, regulations, discusses bothvertical and horizontal angle.The third part is eligible for criminal penalties and the relationship of theinternational protection of human rights, discussed under the protection ofinternational human rights and the personal development.The fourth part is the comparison about China and Russia. Comparison ofhistorical conditions, types, duration and impact on social life, identify similaritiesand differences by comparing, and their respective characteristics.The fifth part deals with the defects and deficiencies about China and Russia qualifications criminal. To discuss specific names, content, application objects, andthe practical effect.The sixth part is the perfect to qualification punishments. Including the modifyabout proposed deportation and deprivation of political rights, and add to the newtypes of qualifications punishment.
