Abstract


Firstly, this paper mainly introduces the theoretical basis of the treatment of jail system, its specific legislation condition and its censorship rules. Secondly, this paper mainly introduces its implementation in practice. Nanjing national government have expectations for the treatment of jail system, but due to the inadequate funds, limited prison personnel’s management quality and unsuccessful supporting hardware facilities, there appeared some inconveniences in its actual execution. This paper selects three youth prisons which are respectively in the Jiangsu province, Shandong province and Shanghai, and introduces the implementation in practice of the treatment of jail system there. Then, this paper mainly analyzes the problems encountered in the execution process of the treatment of jail system of the Nanjing national government period, as well as the causes of these problems, so as to learn some experience and lessons, which are useful for us to construct the treatment of jail system with Chinese characteristics today. Finally this paper mainly introduces its reference value, because its legislation pattern, the setting up of its applicable authorities and enforcement authorities can all provide very beneficial reference for our country. The bringing in and the setting up of the treatment of jail system of the Nanjing national government period is a process of constant development, which had gradually developed in the course of the transplantation of advanced foreign laws, and which is also one of the important marks symbolizing China’s legal modernization since modern times. The treatment of jail system of the Nanjing national government had mainly been written in The Regulations of The Treatment of Jail System of the Nanjing National Government, which had played a very important role in the history of legal development process. Some Chinese scholars have had some research in its development in the contemporary China, however their research findings are mainly about the introduction and description, and in order to excavate its reference value for the modern prison reform in our country and the construction of a treatment of jail system with Chinese characteristics, this article introduces in detail its theoretical basis, legislation and practical execution, and analyzes the problems existing in its actual execution. Synthetic data shows that the treatment of jail system of the Nanjing national government period has reached a quite high level both in the legislation techniques and legislative level, and the lawmakers have given a sufficient attention to it. However, it had not been well implemented in practice due to politic and economic constraints at that time. Through the research, we can gain a full view of the treatment of jail system of the Nanjing national government. The Nanjing national government had used special regulations to draw up the treatment of jail system, though with a bit of imitation, on the whole, the treatment of jail system has adapted to the actual situation of the social development at that time. And in the period many legal experts effort to absorb and change the treatment of jail system and make its own characteristics. Therefore we should given a research to the treatment of jail system of the Nanjing national government.
