Abstract

Transfers are subject property insurance in 2009 \This article from 2009 newly revised \The first chapter, the author from the basic concept of insurance , the insurance law for the current doctrine of the sort and contrast that theoretically there are three aspects need clearance . First, the property insurance of the core concepts of insurance benefits and life insurance in the insurance benefits are essentially different , it should be special provisions to avoid confusion ; Second, starting from the legislation on insurance should be the subject of insurance benefits , rather than the subject matter insured ; Third, should strictly distinguish between the insured and the insured person's different status , and insurance practice synchronization. The second chapter, the author attempts to discriminate property insurance contract between the parties involved in the legal relationship and to explore the subject of the transfer process of the insurance legal relationship changes and effects. The third chapter, the author for the \Taiwan to study legislation and doctrine , made their conclusions and legislative proposals. Finally, the author puts forward the subject of the transfer of property insurance on the concept needs to be improved legislation , the relevant legislation requires refinement , the only way for the rapid development of the insurance industry to provide legal protection .
