Abstract


Antitrust legislation for the United States is the world's first country, the anti-monopoly law has a great influence, system integrity, a long history. Promulgated the Sherman antitrust act of 1890 laid the foundation of American antitrust law, is also the world's first modern meaning of the antitrust laws, for example for the later national antitrust legislation. The birth of the Sherman act has its profound historical roots. The historical factors mainly produced in nearly 30 years after the American war of independence, during the industrial revolution. Industrialization leads to economic structure transformation and economic focus is the economic basis of the birth of the Sherman act; Is mainly composed of small and medium-sized enterprises, farmers and workers, etc. Class by antitrust movement is the social basis of the birth of the Sherman act; The traditional liberal democracy thought is the birth of the Sherman act ideological basis. In this paper, on the basis of research results at home and abroad for reference, try to from the above three aspects to the root cause of the birth of the Sherman act, deep research into the history of on the whole, in order to compete in our country at present stage of establishment and improvement of the legal system have further understanding.
