Abstract


China’s Tobacco Monopoly Law unlicensed production, distribution and business activities of special allocation of administrative punishment to the tobacco monopoly administration shall, while the undocumented behavior of the retail business targeted to industrial and commercial administrative punishment administrative departments. This pattern of administrative punishment configuration is reasonable, whether the streamlining of administrative law, the principle of efficient?To China’s Tobacco Monopoly Law for the tobacco monopoly retail license administrative punishment configuration management behavior problems as a case study, a brief analysis of the configuration problems, the tobacco monopoly retail license for the Identification of the business, investigate the cause of confusion and practice are described, two levels of legislation and law enforcement fields to improve the tobacco monopoly power of administrative punishment were discussed, and finally entrusted with administrative enforcement and the relative concentration of administrative punishment system, on how to address the fundamental behavior of the investigation without a license retail business problems and improve the efficiency of administrative law enforcement and reduce the cost of law enforcement a useful exploration.
