Abstract


Mental patients forced medical administrative coercive measures as a limited right to sexual measures , in the maintenance of public safety and social protection of human rights at the same time is also very easy to infringe the mandatory personal interests . Therefore , both from the theoretical risk prevention , or from the perspective of the standards of international legislation , or to force the issue in the health care system and operational practices from our existing psychiatric patient are an urgent requirement to establish and improve our mentally ill mandatory medical legal system. Through analysis of legislative and institutional evolution of the Western developed countries , on the basis of comparative learn from the experience of developed countries, legislation , considering the status and national conditions of China 's system , according to the nature and characteristics of the mentally ill compulsory medical measures of psychiatric suffering from mandatory health care system legislation guiding ideology and the legislative style choice , the basic principles of the legislation as well as the mentally ill compulsory health applicable substantive conditions for the implementation of the procedures and improper mandatory three aspects of responsibility and relief system design ideas.
