The nearby enrollment policy of the compulsory education in China guaranteed the implementation of nine-year compulsory education free of charge, however, because of the key school policy and the lack of education investment in our country for long-term, there exist a large number of weak schools, which hinder the nearby enrollment policy’s implementation. The nearby enrollment policy cannot stop people’s enthusiasm of school choice; they select schools by various ways. The migration movement which arises from China’s economic development, caused that the floating children still can’t enter school easily; As some local governments are making the nearby enrollment policy, the lack of a fair, impartial and open process, public participation and democratic supervision, which leading some people doubt the nearby enrollment policy.Compulsory education law of the People’s Republic of China (amendment) promulgated in 2006, defines the nearby enrollment policy once again, but some scholars provides a different explanation to this policy, they think it is the government’s obligation, not the school-age children’s obligation; And some scholars proposed that the teaching quality can be improved by school choice.This paper enriches rules for the implementation of the nearby enrollment policy by investigating the policy components and characteristics in Western Countries from the perspective of comparative analysis. And it analyses the participants of problems caused by the nearby enrollment policy and their interests and benefits, dissects the profound reasons for this issue. It also analyses the problems existing in implementing the current nearby enrollment policy from multi Game dimensionality in Game Theory. It puts forwards the central government should strengthen the policy execution, transfer payment from the exchequer; The local government can impels the nearby enrollment policy’s continuous development, improve our overall level of education by strengthen the weak school construction and other measures.
