Abstract


The object of this paper is a bankruptcy crime legislation. Under the conditions of the socialist market economy, bankruptcy is an inevitable phenomenon of survival of the fittest of the main players in the market. In the bankruptcy process, easily generate crime. And non-economic indicators of the adverse impact of the bankruptcy crime to society is beyond measure. Countries and regions in the relatively developed economy and a relatively sound legal system, bankruptcy crime institutional system is also more complete. Our country is not yet a systematic theoretical study of the bankruptcy and insolvency crime, a considerable part of the legislation is still in the blank. The reality judiciary facing bankruptcy crime situation is very grim.
