Abstract


Since the beginning of the new century , business methods patent protection in the countries concerned about hot spots and focus of discussion . The importance of software , business methods as the most important form of business method patents , business method software patents have become increasingly prominent . Qualitative business method software patents and to promote the transformation of the relevant patent legal system , an urgent need to solve the problem . The same time, the major developed countries abroad through a variety of measures to promote the business method software patents , how to deal with only the choice of the times , still require careful study and urgent subject . Modify the background of the current patent law system from the following four parts , the analysis and research issues related to business method software patents , and put forward some of their point of view . The first part is the concept of the business method software patents , is the first chapter . This chapter from the definition of software and business methods , leads to the definition of business method patents and business method software patents , and describes both similarities and differences . Also discussed the characteristics and classification of business method software patents . The second part is the second and third chapters , is a core part of this article . Chapter II mainly from two aspects of the authorization status quo of our current business method software patents , review of benchmark issues such as described, and on this basis, identify the problem and the creative standard for analysis of existing technology . Chapter comparative study , the United States , Europe , three countries , Japan , the patent system was introduced , and from our national conditions on the reference for our existing system . The third part is the fourth chapter on the necessity of a business method software patents system purpose-built , and related systems and practical issues of its own proposals in two ways . The fourth part is the conclusion , a brief review of the full text , summarize the main point of view on this basis .
