Abstract


Decree of the State Council No.439Production Safety Accident Reporting andInvestigation Regulations in the year of2007has specified that production safetyaccidents should be examined by Investigation Groups(IG for short),which areorganized by the State Council or the local governments. According to the decree, theIG has been widely applied to accidents in the areas of production safety. However,practically there exist many problems such as the manning of the main group body, thereport of the investigation process, the institutionalism about Protectorate’sparticipation. As for the existing problems above, open and close at the survey andsolution about safety accidents, the thesis mainly clarifies the concept of IG and itsrelevant contents. Then by analyzing such problems as above, the correspondingsuggestions are put forward as the thesis’s climax, in hope of improving the practicaleffect of IG.From the legal aspects, and by means of the research methods of case analysis aswell as comparative analysis, the thesis is mainly about the study on IG’s manning, itsexisting problems and its corresponding solutions.It is the following four parts thatcomprise the whole thesis. Part one is organized to give answers about ’’what is safetyaccident and how to rank it", after which are the introduction to IG in processing safetyaccidents and further analysis of IG’ s attribute and function. The second part putsmore weight on some legal aspects about IG, which consist of its members and each oftheir responsibilities, its working principles and procedures, and also the format andcontent of investigating reports. Meanwhile，from the practical point, another part havemade a carful and profound study about the existing problems while IG is adopted insafety accidents. Based on the urgent problems and the experiences got in practice,feasible and innovative exploiting methods are put forward in the forth part.
