Abstract


Since it was signed，Cross-Straits Economic Cooperation Framework Agreementhas been in a great concern among the people on both sides. Subsequent agreementshave been in a negotiation. Because of the ECFA, more and more closely thecross-strait economic and trade exchanges, an increase in disputes has begun to takeshape. ECFA involved a lot of subjects, so do not rely on the basis of the jurisprudenceis, indeed, difficult to understand the cross-strait economic and trade relations anddisputes.In this paper, the relationship between the ECFA and the WTO as a starting point,the author recognized the ECFA. From two angles of the disciplines Adjusting Objectand nature I found that there are "blank" areas, is "abandoned" phenomenon, but which,in practice based on the formation of some of the technical requirements has still a lot ofadvantages. Finally, the author draws on the WTO dispute settlement mechanism design"Cross-Strait dispute settlement mechanism Agreement, the Model Agreement crudepractical foundation is weak, hoping to make progress on the basis of criticism.
