Abstract


Ever since a long time ago, issues concerning agriculture, countryside and farmers have always been the key problems to restrict China’s economic and social development and to constrain the construction of harmonious society. The Fifth Plenary Session of the Sixteenth Central Committee of the Communist Party of China proposed the Socialist New Countryside Construction, which was taken as the principal policy to solve issues concerning agriculture, countryside and farmers. In the process of constructing new countryside, the construction of legal system plays an irreplaceable role. Only when the modern legal system replaces the old policy, etiquette and custom and the modern regulation and operation means are developed, can the construction of the socialist new countryside be carried out more successfully. Therefore, it is of great realistic significance for the construction of the socialist new countryside in China and the development of the whole country to make deep research on the present situation of the rule of law against the background of the construction of the socialist new countryside in China, and to explore a construction path of legal system which not only has unique Chinese characteristics, but also can meet the needs at the current stage of rural development in China. On the one hand, it can provide legal safeguards for the construction of the socialist new countryside, accelerate the accomplishment of the construction of the socialist new countryside, and ensure the healthy and orderly development of the economic society in the countryside. On the other hand, with the healthy development of countryside, it also can boost the socialist modernization construction in China, promote the overall, coordinate, and sustainable development of the economic society, and favorable for the construction of the harmonious socialist society.In the field of China’s countryside construction theoretical studies, scholars mostly focus on issues concerning agriculture, countryside and farmers, as well as countryside economy, and they have great achievement in such research and study. However, there are few studies on countryside legal construction. Even such few studies, which are considered to be unsystematic, majorly concentrate on static research instead of dynamic construction contents. Against such background, this paper tries to explore countryside legal construction under the circumstance of the Socialist New Countryside Construction This paper intends to begin with the analysis and study on the status quo of the Socialist New Countryside Construction from the angle of legal construction with the purpose of establishing the designing and countermeasures of the new countryside legal construction. This paper falls into five parts as follows: forward, overview of the new countryside legal construction, the analysis of status quo of the new countryside legal construction, completion of the new countryside legal construction and the conclusion.In the part of forward, this paper will first give a brief review of legal construction research in the countryside by current academic circles, emphasizing on the viewpoints which have significant impact on this paper. Moreover, the research key points and innovation points will be presented in this part.In the first part, the building of socialist legal construction in China’s new socialist countryside as well as the vital impact of this legal construction on the economic development of the contemporary socialist countryside will be analyzed.In the second part, by analysis of the current situation, it indicates that the contemporary Chinese countryside legal construction has had a preliminary development and has made obvious improvement. The countryside legislation and law enforcement have been completed, as well as judicial supervision and protection have been strengthened, thus the legal consciousness of farmers has been enhanced and fundamental rights obtains guarantees. However, on legislation, enforcement, judicature as well as the cultivation of legal consciousness, there is still a large deficiency.The author takes the third part, namely suggestions on the completion of Socialist new countryside legal system construction, as the core and key of the thesis. In this part, the author specifies that the guideline and principles are the preconditions of countryside legal system construction; to foster countryside legislation, to perfect law enforcement mechanism and to complete judicial system are the key; to popularize legal education and to improve farmers’legal awareness are the metal safeguards; to perfect countryside social security system and to establish non-government organization networks are the institutional support.In the last part, the author concludes that socialist new countryside legal system construction requires not only the government’s investment, involvement and guide, but also concrete consideration of countryside reality so that farmers’enthusiasm, initiative and creativity will be released and amplified. As more and more attention are paid upon countryside legal system construction, the deficiency and depletion that arise in the development will be made up and countryside legal system construction will be perfected.
