Abstract


Concerning the economic construction, the issue about the legal construction of anti-monopoly becomes very important at the present stage. As we all know, there are many important contracts between the theory of the Marxism Monopoly and the legal construction of the antitrust. The exposition about the contracts between them includes three parts:The first part is about the complication of the socialist market economy and the limitation of the Capitalism Monopoly theory. It is the composite factors that decide the complexity between the socialist market economy and the capitalist market economy. Particularly, the composite factors include the conflict between the publicly owned idea and the private owned idea, the conflict between the ideas of the development of the Plan Economy or the Market Economy, the conflict between the economy’s development and the law environment, and the conflict between the purposes of the developments for personal or public. Meanwhile, the contents of the Capitalism Monopoly theory which is include the economic basic, the culture basic and one-sided recognization, predestine to fail to guide the socialist market economy.Beside this, the theory of the Marxism Monopoly has its scientificalness and the applicability about the socialist market economy. The Marxism Monopoly Theory develops the useful and discards the useless,changing itself to suit the Chinese fact. Not only do it recognize the facts of exist at the same time between the monopoly and the complete, but also it know the harmness brought by the abnormal complete. And what is more important is the Marxism Monopoly creates the Twoness of Monopoly theory. These characters determine it has the essential differences with the Capitalism Monopoly theory. As the socialist market economy has its complexity, the Capitalism Monopoly theory has its limitations, the Marxism Monopoly theory has its scientificalness, and then there are the same social characters between the Marxism Monopoly theory and the socialist market economy, the Marxism Monopoly become more suitable to guide the construction of the socialist market economy. The last but not the least part is how to use the Marxism Monopoly theory to guide the construction of Chinese anti-monopoly. What we should recognize is the Marxist Monopoly theory and the legal construction of the anti-monopoly could supplement each other. While the special period of the economic recovery, it is more important to recognize the essential connotation and the legal construction of the anti-monopoly. The Marxism Monopoly theory guides the legal construction of the Chinese anti-monopoly. And this could be found in the course of the legislation and the enforcement of the Chinese Antitrust Law. Compared to this, the practice of the construction of the anti-monopoly could enrich and perfect the Marxism Monopoly theory.
