Abstract


Summary procedure as an efficient , fast dispute resolution mechanism , has become a modern rule of law in countries and regions, the Administrative Procedure Law is an important institution . In recent years , as China's process of promoting the rule of law and the constant improvement of administration according to law , administrative disputes in real life but also with the growing number of events . Administrative proceedings single ordinary trial procedure has seriously affected the fairness and efficiency of litigation . Judicial practice shows , both in protecting the legitimate rights and interests of administrative relative person , or in the promotion of the executive administration according to law , according to the specific circumstances of administrative litigation cases set up with suitable pluralistic system of administrative proceedings , has become China's judicial reform an urgent task . This paper attempts to grasp the legal summary administrative proceedings based on a combination of administrative litigation trial practice , learn from the world's major countries and regions of administrative litigation experience in the development of summary procedure is proposed to adapt to the specific national conditions to build the administrative proceedings summary of some of the ideas . This paper is divided into five parts, the first part discusses the concept of summary administrative proceedings , characteristics and development context, the second part of the trial from the improved efficiency and achieve administrative proceedings objective and rational allocation of limited judicial resources to solve administrative proceedings typed four aspects discusses the summary of the necessity of administrative proceedings . Third part of the development status of our judicial environment , from the rule of law , administrative law , judicial reform, rule of law and circumstances and the characteristics of the administrative proceeding itself , drawing on our many years of trial work practice , expounded China's establishment of administrative Summary Procedure feasible. The fourth section describes France, Germany and China's Taiwan region summary administrative proceedings , summary administrative proceedings to explore commonalities and trends , propose practical learning experience in our country . The fifth part is a core part of this article , be determined from the scope of the case for the definition of the subject , the transformation of judicial organization and the specific arrangement of four aspects of the program put forward our ideas summary administrative proceedings .
