Abstract


The jury system is a distinctive legal system of Western countries, it \countries in the world, also implemented in some countries of the former Soviet Union, Eastern Europe, and transplantation in our country. \state power, invariably in their constitutions or basic legal document expressly provides that the jury system. But until now, the fate of the jury system in the country are not the same, some countries continue to develop and refine the system and become the object of other countries have followed suit; jury system applies in some countries was narrowing trend. The jury system, there are two types: one is mainly applied in common law countries such as the United Kingdom, the United States, another is mainly applied in civil law countries, such as France, Germany, the two have some differences. The combination of specific judicial practice of the jury system, is in the draw on the basis of the former Soviet Union judicial experience and gradually formed, and its development has experienced several ups and downs. The judicial practice run of our jury system is not satisfactory, it exists in our academic community of the System, \But I believe that the reason for this phenomenon is caused by the jury of the country's legislative and institutional imperfect, and can not simply deny the people's jury system. The author of the article text is divided into four parts, writing ideas along the following lines: The first part of the article describes the meaning and historical development of the jury system. To do a more detailed introduction to the two main types of the jury system, and they made a comparative study. The second part described the function of the jury system. That the jury system embodies judicial democracy, promote judicial justice, strengthening the independence of the judiciary, and to maintain judicial integrity and legal education can not be underestimated the role of citizens. The third part of the historical evolution of the jury system in China were introduced, and analysis of the status quo. , I think our current jury system run is not satisfactory, mainly because our country in the legislation is not perfect and the specific system caused by rough, so the current task should be how to improve it, rather than abolish it. The fourth part of a concrete idea on how to reform and improve the jury system in our country. Including the improvement of the legislative level and system level. This paper comparative analysis of the research methods. A comparison between the the Existing Two Schools jury system, and compare them with the people's jury system in China, these comparisons, both legal cultural comparison comparison of specific systems. Through multi-level analysis, the author put forward their views on the reform and improvement of the people's jury system in China.
