Abstract

Agent is an important part of the legal system , the proxy system plays a very important role in the social and economic life . Insurance is widely used in the insurance agency system . The operation of the insurance business in large part to establish the basis of the agency system , insurance agent behavior extremely important for the insurance company , the rights and obligations of the insured and the insured . China's insurance industry is also promoting the insurance agency system , insurance agency system introduced to reduce the operating costs of the insurance company , to promote the rapid development of China 's insurance industry . But the problems caused by the insurance agent increasing number of affected the integrity of the image of the insurance enterprise , the rocky hill hinder a sustained , stable and healthy development of China 's insurance industry . In order to maintain the safety of insurance transactions to protect the relative people 's interests , October 28, 2002 , adopted by the Standing Committee of the thirtieth session of the Ninth National People's Congress Standing Committee of the National People's Congress , on amending the lt ; Insurance Law of the People 's Republic of China the gt; 's decision. \Insurance Law revised for the first time in the form of legislation to establish an insurance agency by estoppel system , clear the rights and obligations of the insurance company and the insurance agent insurance agency relationship , which is conducive to the balance of the insurer and the insured interests as well as to improve the level of integrity of the Chinese insurance industry , insurance agency system more robust . The establishment of the insurance agency by estoppel system in terms of the activities of insurance agents , in order to protect the interests of the policyholders and the insured , but the agents that insurers face significant operational risks and equitable principles of civil law consider how to balance interests between the insurer and the insured has become an issue that we need to focus . This paper in theoretical study site at the same time , combined with the judicial practice in insurance agency by estoppel , hoping to help the connotation of the in-depth understanding of the insurance agency by estoppel system .
