Because the increasingly prominent questions of copyright are triggered by advances of information technology instruments, the strengthening trend of copyright is becoming increasingly apparent. At the same time, copyright restriction system defined as the limitation to the exclusive rights which are explicitly provided by the law is very important for its legal values such as fairness and justice and the reality of the role in coordinating interests of every party. During the process of information resources construction and the services of network-based communication, Digital Libraries are greatly restrained by copyright. This situation is a serious obstacle to digital library’s development. Then, a digital library of its own characteristics how to make full use of copyright restriction system to avoid the risk of copyright is becoming the focus of stakeholders’ attention. Firstly, this article introduces the concept and legal basis of copyright restriction system, and points out the necessary of copyright restriction based on strengthening of copyright under the network environment; Secondly, clear the legal status and applicability to different character of digital libraries; on such basis, this article mainly analyze the principal of fair use, statutory license and compulsory license applied in the digital library, and looks ahead of its development prospect combined with copyright legislative practice both at home and abroad. This article is hoped to promote the relevant aspects of theoretical research and straighten out the legal barriers of digital libraries’ development, in order to respond to various challenges flexibly and effectively under network environment.
