Abstract


Community correction’s the value of existence basis is“fair”,”justice”and”democracy”. In the 1970’s,western countries such as Britain and American implement the system of community correction ,which bursts strong vitality.The pilot work of community correction in China have developed nearly twenty years and has obtained some achievements.In February 25, 2011,community correction was finally regard as a legal status according the law of the People’ Republic of criminal law amendment (8).It should be confirmed to the development of the pilot of community correction during the last twenty years in China.However,by contrast of the foreign community correction ,China’s community correction about the management mechanism, the correction method, the correction object and legal construction correction has a long way to perfect it .This paper based on the background of the above phenomenon.Then,Tightly integrated with Beijing, Shanghai and Guangxi zhuang autonomous region of community correction concrete themselves’ methods.finally, the insufficient is provided and there are improving suggestionsThis paper is divided into four parts:Part one:Through analyzing the community correction ’s the concept , the nature and the features, this paper point of view can be adopted.This point can be used to analyse the question concerning what follows in the passage.Part two: Through the recovery judicial,the new view of criminal punishment, the criminal execution of efficiency,the criminal policy and the concept of democratic, the existing foundation of theories of community correction is analyzed. This Mainly solves for the rationality of the existence of community correction.Based ont the theoretical analysis,the existing significance of community correction can be grasped from the point of view of the macro.Part three: The purpose is to introduce the Beijing, Shanghai and Guangxi zhuang autonomous region in community correction methods of introduction.This is the part of the empirical.Their the research works of community correction on different days and their economic development level is not the same.Therefor,This is more practical value.Part four:Through the analysis of the third part and While analyzing the first part and the second part ,the shortage of community correction can be pointed out .Finally the methods to solve the problems put can be suggested.This part should be the focus of this paper.The existence of the above parts of the value is to solve the problem of the proposed question by the part four.
