Abstract


Microfinance as a product of financial innovation develops accompanied by accumulating experiences of developing countries and government-owned banks’traditional loan methods to the poor and small companies and by absorbing the characteristics of non-governmental loan. As an effective method to alleviate the poverty and develop finance, microfinance has gradually been accepted by countries worldwide. In recent years, our Government laid great emphasis on development of microfinance. In particular, in the past two years, reform on microfinance quickened up and a series of innovative measures were proposed welcomed by the market as well as by those who demanded microfinance.However, due to the bottleneck induced by the law, a lot of problems such as inaccuracy of law privilege, law restriction on capital operation, dispute caused by interest rate distribution and imperfection of regulation system emerged. Targeted at those problems, the paper defines the concept and characteristics of microfinance. According to the creation and development process of microfinance, the paper summarizes the external environment of microfinance and the important role it plays during the process of economic development. Different from other common finance, microfinance clarifies the definition of law regulation and requirements of multi-finance environment on law regulation in a scientific way and signifies the significance of law regulation on the development of microfinance.The paper consists of five parts as follows,In the first part, the paper gives the definition of law system on microfinance regulation. This law system on microfinance regulation is comparatively a new definition, and it still holds obscure definition in the theory field. Therefore, in the first part the paper firstly analyzes the law relationship of microfinance regulation. It then demonstrates that microfinance belongs to the new-type credit finance similar to project financing such as non-mortgage and security. Microfinance should adjust the social relationship, namely, microfinance relationships, among all activities incurred by those microfinance activities. Law relationship of microfinance regulation by its nature is incurred during the regulation of institutions either belonging to the nation or designated by the country on those microfinance institutes, microfinance business and loan market. It also includes the regulation relationship incurred during the regulation and supervision on those microfinance institutes, regulation relationship on microfinance business charging relationship on those microfinance institutions which violated the law. The paper holds that it belongs to the management relationships, so it is applicable to the basic principles of economic law.The second part emphasizes on the theoretical analysis of law system of microfinance regulation. The paper, by adopting theories of economics, analyzes the significance of microfinance development. It then confirms the important role microfinance plays in promoting social development from the perspective of sociality. At the same time, it also shows that microfinance is an essential manifesto of justice from law’s perspective. It then makes clear that due to the fact that microfinance has different risk characteristics different from other common commercial banks, how to effectively carry out regulation and make correct definition on microfinance is of great concern. This problem not only involves with regulation innovation but the creation of supervision law as well.The third part includes the comparative research on law system of microfinance regulation. The paper analyzes different countries’microfinance regulation modes. And it compares the supervision type of developed countries with that of developing countries. It also makes sure the establishment of China’s microfinance regulation rights and differ it from other regulations in terms of regulation patterns.The fourth part includes the problems of our current microfinance regulation situation. The paper identifies the development of China’s microfinance and emphasizes the different stages of our country’s microfinance development. Meanwhile, it also defines types of our country’s microfinance and summarizes the traits of microfinance. By analyzing the problems of microfinance encountered during our country’s development, the paper looks to the prospect of microfinance. The paper also comments on the regulation mode of our country’s microfinance mode, summarizes the political issues and comments on the current microfinance law regulation.The fifth part includes suggestions on constructing law system of microfinance regulation. The paper, based on problems of current law system of microfinance regulation, proposes suggestions on law system of microfinance regulation, and designs the regulation framework for sustainable development of microfinance. The paper then points out principle and objectives of regulation as well as the standard of regulation. Lastly, the paper, based on regulation law system, proposes two methods and ways of revising the past laws and staging new laws. Through the construction of systems, the paper establishes regulation system of microfinance and promotes healthy and sustainable development of microfinance to maintain sound development of China’s economy.Meanwhile, the paper attempts to make innovations in two parts.Firstly, the paper tries to make innovation in terms of data research. Currently, it is rare to see research papers and data on antidumping laws. The paper, by collecting academic papers both at home and abroad and drawing experiences from some original English books, introduces some classical case studies of antidumping in American history. Some of those case studies never appear in the national papers, which to some extent contribute to the relevant studies on this topic.Secondly, the paper tries to make innovation in terms of main schools and views. The paper make analysis on academic papers which have been discussed by others, but it attempts tot make some breakthrough towards those main ideas or thoughts, which are mainly revealed in traits and law relationships of microfinance regulation law system and construction of microfinance regulation law system.
