Abstract


With the rapid development of modern biotechnology, the various functions of different genetically modified organisms continue to emerge, bring huge economic benefits to mankind. However, uncertainty biotechnology, genetically modified organisms on the human health, ecological environment, biological diversity, and social and ethical aspects of the new challenges. The face of the potential risks of genetically modified organisms, people have a different understanding. For this reason, the safety of genetically modified has become a hot topic of debate all over the world, and cause the world as well as the international community attaches great importance. In order to achieve the purpose of avoiding disadvantages, many countries and international organizations in the development of biotechnology, and actively carry out legal research on the safety of genetically modified organisms and to develop, promulgated and implemented a series of laws and regulations of the safety of genetically modified. Based on the countries of GMOs safety awareness and the interests and needs of different, many countries and regions of genetically modified organisms and their products take a different response attitude. Which can be roughly summed up as the United States, represented by the easing mode, strict mode in EU and Japan on behalf of the compromise mode. Has been our highly concerned about modern biotechnology, has made great achievements in the development and utilization of genetically modified organisms. Safety issues of genetically modified organisms, China has also developed a series of laws, regulations and management system suited to China's national conditions, to some extent, to meet the needs of our transgenic biotechnology development. But in recent years, the continuous emergence involving genetically modified biological its product disputes and controversies, such as Nestle transferred gene food logo dispute and now fights the hubbub of the transferred gene in rice commercialization of planting dispute, which all show that the our current safety of genetically modified organisms legal Control exists a serious shortage. Domestic scholars are beginning to realize the importance of this issue, and the improvement of China's legal control on the safety of genetically modified extensively studied. In order to meet our transgenic biological development needs, China should learn from foreign transfer genes biosafety legal control on the basis of experience, combined with domestic GMOs safety laws control the status quo, to take partial strict the compromise mode, respectively, from the legal system and management mechanism two aspects to Improvement of the safety of genetically modified legal control.
