Abstract


Medical professional and high-risk behavior determines the medical disputes inevitable . In recent years, with the increase in the patient 's health awareness and rights awareness , medical malpractice rising trend . How to effectively resolve medical disputes , building a harmonious doctor-patient relationship is related to the development of health , has become a hot research scholars . This article describes the history of medical malpractice prevention and treatment at home and abroad , the concept and connotation of medical disputes , medical disputes characteristics as well as China , the United States , Japan , the three countries in the prevention and treatment of medical disputes measures, and the use of comparative research and documentation the analysis method of combining the following three aspects were analyzed and compared , first compare the characteristics of medical disputes ; followed by a comparison of the medical liability insurance ; Once again, the comparison of hospital management and medical staff awareness of service . Summarizes and analyzes the similarities and differences of the three countries on medical malpractice prevention and treatment measures , to identify the current status quo of the country can learn from , the following point of view : First, accelerate the construction of medical security system for the poor and vulnerable groups to build a barriers ; gradually solve the health resource allocation unfair imbalance of the status quo ; Third, increase investment in health , the establishment of UNITAID , improve medical treatment ; fourth is to develop and strengthen the sense of service of health care ; Fifth, the gradual development of medical liability insurance, the implementation of the statutory medical liability insurance ; Sixth, strengthen the construction of the laws and regulations of the health care system ; seven specifications in malpractice , so that not only understands doctors knowledgeable about the law and judges to deal with medical disputes ; eight development litigation resolution mechanism.
