Abstract


Innocent is an important property of modern civil law system, has been out of possession of material can be applied to obtain good system theorists are hotly debated. The community from material suitable for the possession of great concern in good faith system, reflecting the market economy environment, the law charged with the promotion of commodity circulation, maintaining the important mission of the entire market transactions. China’s "Property Law" does not establish good faith for the material obtained from the system, the transaction is bound to damage the trading rules and order. Therefore, China should establish from the material in good faith system. Based on the theoretical analysis made in good faith and the world from the material of the system provides a comparison made in good faith, based on the actual situation and put forward some suggestions.
