Abstract


Sentence proposal is procuratorial organs, the accused shall be convicted of criminal punishments to judicial organs put forward ideas. From the supreme people’s procuratorate issued to the people’s procuratorates of the sentence on the implementation of the opinion that the work of passing sentence, procuratorial organs of the proposed reform has achieved initial results in the exercise of his sentence suggestions in the way for the benefit of exploration and, in the legal profession have also been widely acknowledged. But by analyzing the punishment of the proposed reforms in recent years the judicial practice, can see that the punishment suggestion system creation process there are still many shortages. To establish and improve china’s procuratorial organs of the proposed system, we learn from other countries of the sentence suggestion systemTo implement the proposed system, the punishment can’t stop at the meaning of law and legal principles level, must be clear in legal proceedings is a part of the proposed system, the punishment of the proceedings, make the punishment that the right to become a procuratorial organ of power, have to achieve real procedural fairness and justice. This further brought out the punishment of the proposed system, the status and operation procedure, a method, classifying operation and made a detailed description. Procuratorial organs of the proposed system of the sentence to establish and implement and complete related to security system, to make the punishment in promoting the proposed system of justice play a bigger role.
