Abstract


Modern Criminal stressed the unity of the fight against crime and the protection of human rights , and the rights and powers of the characteristics of the conflict the confessions system has different confessions system represents a different value orientation . With the advance of the rule of law in China , the idea of ??the progress of the criminal proceedings , how to improve the confessions system more and more people are concerned about , especially since the disclosure of forced confessions led to some trumped-up of tension, the right to silence and truthfully confessed obligations the focus of the scholars to explore . Analyzing from the rights confessed system and power conflict reasons , compared truthfully confessed obligation and right to silence , drawing on the trend of change of the current right to silence , and truthfully confessed shortcomings of the obligation system analysis and appraisal and proposed solutions designed to adhere to the the premise truthfully confessed system , looking to the rights and powers of the conflict in the confessions of the equity .
