Abstract


Nowadays,with the rapid development of network and transportation,people strongly expects to feel and get close to nature.At the same time,the concept of tourism is undergoing changes.More and more tourists ,especially the youth, are absorbed in tring self-service travel rather than traditional package tour.In addition,stimulation and original nature landscape are also full of attraction for them.For these reasons, self-service adventure travel generated. While this new activity is booming, safty accidents happened frequently because of its high risk.Though self-service adventure travel is one of the risky businesses in china,we have not revelent laws and regulations to regulate these activities,so that our courts do not know how to deal with these type of cases when they confront with them. In most cases, the court has to deal with them respectively according to analyzing jurisprudence,of course,hardly gives a convincing judgment.So,we need to consider how to avoid accidents and how to solve legal disputes when accidents happen in the activities of self-service adventure travel. This thesis intends to explore legal issues existing in the activities by analyzing some typical cases,and to give some sugesstions to these issues. The thesis consists of following parts: the first part is an introduction of concept,characteristics and development status of self-service adventure travel. The second part, based on the analysis of two cases of self-service adventure travel which have aroused with great repercussions in our country ,the writer attempts to explore some relavent legal issues and puts forward some personal views.In the third part,legal issues are proposed in activities of self-service adventure travel,including the absence of revelent access system, unclear legal responsibilities and the lacking of insurance system. The last part infers to some countermeasures to the legal issues which are mentioned in the third part,such as establishing revelent access system,clearing the legal responsibilities for parties and perfecting insurance system of self-service adventure travel.In a word, the writer wishes this thesis will play a positive role in the healthy development of self-service adventure travel,and thereby promotes the construction of tourism law.
