Abstract


The use of the modern theory of criminal law statutes juvenile delinquency system a little early to study . The article is divided into three parts overall . The first part of the use of modern criminal law criminal theory , abstract juvenile crime in the the Tang law in modern criminal law theory underlying theoretical framework for general discussion the Tang law provisions minors crime . The second part is a common theoretical platform based on the first part of the system and juvenile delinquency the modern penal juvenile delinquency system embodied in statutes comprehensive comparative analysis , from the legislative ideas, legislative mode , penalty , and the severity of lessons criminal the comparative analysis of several aspects of the crime provisions to review the past and present pros and cons of the pros and cons . The third part is the pros and cons of pros and cons of enlightenment in the modern penal system of juvenile delinquency , juvenile delinquency modern penal system should absorb the Tang law to educate mainly embodied in the principle of crime prevention , the fight against the violation of the basic rules of conduct for the the main principle of crime and punish juvenile delinquency implementation of the principle of forgiveness , etc. , while the tight the Tang law in unreasonable ingredients to juvenile delinquency in our criminal law system reaching perfection .
