Abstract


For a long time , conviction and sentencing of crime are central issues surrounding criminal justice , fundamental research is simply how best to solve the crime , in order to achieve the effect of education and prevention . To adapt to different situations , crackdown , temper justice with mercy criminal policy of endless variety . With the continuous development of market economy , the increasingly frequent contacts between people , as well as the type and scale of disputes crime is also expanding , and traditional country- based criminal justice center, the implementation of \evil \These led directly to the criminal justice community governance increasingly inefficient and ineffective , but also to bring pressure on the judiciary itself in many aspects . Restorative justice philosophy emerged to domestic criminal justice theory and practice have brought no small shock . So what is a criminal justice philosophy, the concept of the traditional criminal justice what are the advantages , what are the main factors which , will produce what kind of impact on all subjects , a series of problems have cropped up . This paper contrasts and take dialectical thinking logically , the interpretation of restorative justice from the perspective of the subject of restorative justice can bring us surprises.
