Abstract


When entrusted in criminal proceedings, the lawyer, as the suspect, the defendant's counsel for his defense, this is not only to maintain the suspects, the legitimate rights and interests of the defendant, but also help to help the judiciary to identify the facts of the case, get clear truth, and safeguard judicial justice. However, some of the fundamental rights of the reality, lawyers can not be guaranteed, also a frequent occurrence of personal liberty threatened. Lawyer Li Zhuang was sentenced to one year and six months for perjury, he was just of many by a typical representative of the prosecution lawyers. Practicing lawyer personal rights are not guaranteed, so many lawyers afraid or unwilling to handle criminal cases, which led to the shrinking of our lawyer criminal defense business, not to achieve the interests of justice, at the same time is not conducive to the building of society based on the rule of law in China. Therefore, in our established lawyer criminal defense immunity system of practical necessity and urgency, given lawyer criminal defense immunity is determined by the occupational characteristics of lawyers, criminal defense lawyer too special status requirements. This paper consists of three parts of the Introduction, body and conclusion. Our country at this stage counsel for the decrease in the number of criminal cases, lead to further food for thought scholars, lawyers in the country to establish immunity from criminal defense system really necessary. Body composed of five parts: The first part focuses on Lawyers Criminal Defense definition and characteristics of immunity, this section describes the theoretical circles attorney criminal defense immunities several different definitions put forward by analyzing and comparing their criminal defense lawyer three basic characteristics defined understanding of immunity and the immunity lawyer criminal defense. The fifth part is to ensure that the system can be effectively implemented, taken legislative protection, industry self-regulation security protection measures.
