Abstract


With the increase in the development of human society, the ocean and the use of marine activities, the marine environment is a growing problem. Especially in the Oil Pollution ie, mainly petroleum and its related products, such as marine pollution, the most serious, the oil one of the major pollutants in the ocean, has resulted in serious harm to the marine and countries offshore coastal environment. Currently, the countries to solve the problem of pollution of the marine environment, especially a number of laws and regulations have been developed to prevent marine oil pollution problem, but its implementation is still far to reach the standard, which indicates that the relevant legislation and measures need to be further improving and perfecting. This article from our marine suffer the oil pollutants serious pollution situation and our current talking about preventing defects or deficiencies in the legislative status quo of marine oil pollution, combined with and learn from various international treaties and agreements, as well as international law on the specific protection measures, as well as national legislation advanced the prevention of marine oil pollution legal principles and measures, and improve the prevention of marine oil pollution legislation on China. The text is divided into five parts. The first part is the introduction of subject background, the purpose and meaning, and the research status at home and abroad with the main content described in this article. The second part of Marine Oil Pollution meaning defined, and on this basis, the in-depth analysis of the characteristics of marine oil pollution, causes and hazards. China's current preliminary form of the legal system for the protection of the marine environment, but in many respects, there are still problems with defects. Imperfect legal measures as well as issues such as the legal system is not perfect due to the lack of marine oil pollution liability, directly affect the marine ecological environment in China, as well as relevant laws and regulations can be implemented. This paper analyzes the United Nations and other international organizations to develop international treaties or agreements, as well as the United States, Britain, Japan and other countries of the prevention and control of marine oils related legal and management status, and analysis of these different modes of legal and management system for the above-mentioned international treaties or agreements, as well as the strengths and weaknesses of the national laws and the experiences of other countries, starting from the system of legal norms, improve relevant laws and regulations and the system of marine oil pollution prevention, to protect the marine eco-environment and safeguard China's maritime rights and interests.
