Abstract

In 2008, the UN Security Council to give member states the authority to combat Somali pirates. 2009, the UN Security Council held an open Council on Somalia piracy resolution unanimously adopted resolution 1897, the Security Council decided to Resolution No. 1846,1851 on Member States and regional organizations and the Somali Transitional Federal Government, in cooperation Somali waters to combat piracy and armed robbery acts authorized period of twelve months until 30 November 2010. In recent years, dozens of countries to escort merchant ships through mutual cooperation and other means, to rescue a group of merchant ships and their crews, and achieved certain results. However, we have to admit that behavior is still rampant pirate attacks, piracy is still often succeed. Monitoring Group on Somalia has submitted the report, the ransom paid to the pirates continue to increase, as well as an arms embargo against Somalia not effectively implemented, are fueling piracy off the Somali coast. World shipping is facing tremendous pressure. Cargo or personnel in case of robbery, if the government or relevant organizations to rescue invalid, the ship or cargo majority will choose to negotiate with the pirates, to pay the ransom, in order to ensure the safety of cargo and hostages. However, a huge amount of pirate ransom and involve multiple interests. In this paper, rampant piracy situation in reality, designed to combine theory and practice, in-depth Analysis of pirate ransom with the general average, marine insurance relationship, the focus of the pirates ransom and interests within the parties bear responsibility sharing, in order for the theory and practice of provide recommendations and references. Besides the introduction and conclusion, the paper is divided into three parts. The first part of the pirates ransom overview. This part is mainly combined with relevant case studies and data, discusses the concept of piracy, the dangers of piracy, piracy and other similar acts of distinction, the concept and characteristics of the pirates ransom basic issues, and focus on analyzing the legality of ransom payments pirates problem. The second part is the pirate ransom with the general average. Starting from the nature of pirate ransom will focus on analyzing possible inclusion in general average pirate ransom areas, simultaneous analysis of the general average in the case constitutes a problem. The third part is the pirate ransom and marine insurance. This section focuses from an insurance point of view, analysis of the current insurance system can cover the risks and how to address piracy pirate ransom.
