Abstract


The global financial crisis triggered by the U.S. subprime mortgage crisis \Had a great impact and influence of the crisis on the world's major developed countries. Reflection of the financial crisis, one of the root causes of the financial crisis is the lack of financial supervision in the process of financial liberalization. Therefore, Europe and the United States, as well as the European Union have launched a response to the crisis of the financial regulatory reform plan. International financial organizations in order to maintain the stability of the international financial market have also increased the standard of international financial regulation. This article is in this context, research legal issues of international financial regulation of the financial-crisis era, On the improvement of the financial regulatory system in China. Article the definition and description of the basic situation of the financial regulatory focus compared before and after the financial crisis, Britain and other countries and international organizations for financial regulatory aspects of change and reform programs, pointed out that the impact of the financial crisis on the international financial regulatory system, as well as the United States and Britain and other countries make the response. It showed what lessons we should draw in the current financial crisis, what is the revelation of the crisis on China's financial regulatory, and should put forward ideas and proposals for how to improve the national legal system of financial supervision. The goal of this paper is to understand the financial status and direction of reform of financial supervision in developed countries, so as to explore how can we achieve the most effective financial supervision both to maintain the efficiency of the financial sector and also enhance the purpose of the security of the financial system, which is China's financial regulatory the future development of the system to provide a reference. The paper is divided into six chapters. The first chapter is an overview of the financial regulatory connotation. This chapter explains in detail what is the meaning of financial regulation, financial regulatory system, the purpose of financial supervision, financial regulatory principles and financial regulatory significance. Scientific definition of the relevant theory helps to lay a solid theoretical foundation for the later discussion. The second chapter deals with the international financial regulatory status quo before the financial crisis. This chapter discusses in detail the legal system of international financial regulation, financial supervision and the legal system in the United States, the UK financial regulatory legal system, the legal system of financial supervision of the emerging economies, EU financial regulatory legal framework, Basel system, international monetary organizations. The third chapter discusses the impact of the financial crisis on the international financial regulatory system. This chapter first introduces the financial crisis as well as the relationship of the financial crisis and the financial regulatory system, and then discusses the defects of the international financial regulatory system before the financial crisis, these defects include, but are not limited to, regulatory race to the bottom \limited by the terms of reference of the coexistence of regulatory overlap and regulatory vacuum, the lack of macro-regulatory functions and are not in place to protect the financial interests of consumers, and finally discusses of multinational financial regulatory system defects, as well as the impact of the financial crisis on the international financial regulatory system. The fourth chapter analyzes the reform of the financial regulatory system in Britain and the U.S. after the financial crisis. This chapter discusses the U.S. financial regulatory system reform and the reform of the financial regulatory system, a detailed discussion of the financial crisis after the United States and Britain two major Western countries reform and response to the financial crisis made. The fifth chapter deals with the reform of the international financial regulatory system after the financial crisis. This chapter focuses on the EU's financial regulatory system reform, G20 and the Financial Stability Board and the Basel III reform of the financial crisis to make and respond. Chapter VI to investigate the financial crisis, China's financial regulatory reform of the legal system. This chapter focuses on the main problems of our existing financial regulatory system, the national response to the crisis of our inspiration and our improvement of the financial regulatory system put forward concrete proposals and ideas.
