Abstract


What is a commercial secret yet , but trade secrets defined basic similar description . Trade secrets means the right to legally have specific confidentiality and the right to take measures to protect the commercial value of technology information and business information . From a process point of view of the countries on the protection of trade secrets , almost all experienced from spontaneous protection to the national legal protection of a long journey , the reason is that the commercial secrets hidden value ; hidden for the legal protection of trade secrets the difficulty value its for the holders of the economic benefits . Therefore it infringed its possible , especially today such a developed market economy , the flow of talent frequent social mobility of personnel also contributed to a certain extent, and increase the possible infringement of trade secrets and difficulty . Therefore , the countries of the world have to regulate it to the reality of the problem through legal means , and China is no addition . Exist in the legislation , but in view of the legislative late start in China , inexperienced , too principle , lack of interoperability and other issues , so we need the actual situation in our country and learn from foreign legislation , by strengthening our system legislation , while strengthening the flow of talent measures to prevent abuse of trade secrets , through the development of secrecy and confidentiality agreements signed , and strengthen employee security awareness , thus effectively not only guarantee the rational flow of talent but also be able to protect the special object of trade secrets will not be violated .
