Abstract


"Ten new countries, " the court makes the introduction of similar cases encountered in resolving the difficulties in applicat ion of the law. This article attempts to analyze the following two aspects:first, from the "ten new countries," the legal nature of the angle of the "default pol icy" for the feasibility of force majeure or change of circumstances. By compar i son, "Policy default" more in line with the applicable elements of the situation changes;second, from the "ten new countries," the purpose of the introduction of the angle, combined with comparative analysis of two theories, the "policy of non-compliance" as a situation changes, more meet the "ten new countries, " the purpose of the introduction. At the same time, the policy body of the contract itself is related to the distribution of benefits, should not only legitimate, but also has reasonable.
