Abstract


As a closely related to agricultural intellectual property rights, the nature of the geographical indications of agricultural products depends on its internal economic and social value, and ACTS as a product of origin and quality indicator, involving the interests, between interests of protection is of great significance. For more than twenty years experience of geographical indication protection in our country, but in the use of the system and the market still exist many uncoordinated and conflict. In 2008 since the implementation of the measures for the administration of geographical indications of agricultural products of geographical indications of agricultural products management by the two departments to rise to the three departments, between departments of the coordination problem more prominent. Reference to the relevant research results both at home and abroad, this paper USES comparative method to protect geographical indications of agricultural products in the international law, the "new world" and "old world" of protection, the main legislation protected mode is analyzed. On the basis of the current protection system of our country are discussed and evaluation, and in heilongjiang province as an example for empirical analysis. Finally according to our country's protection present situation, the actual national condition and foreign experience protection Suggestions are put forward.
