Abstract


With the rapid development of social economy, people’s life quality and standard has been improved greatly, however, we have to face a new social problem- kitchen waste management, which is closely related with our daily lives. This phenomenon is opposite to our social target, which refers to construct the resource-saving and environment-friendly society, and definitely will impede our country’s integral development and entire social progress as well as hinder our constructing harmonious socialist society.What a pity is that under the objective and severe situation there is not a united and comprehensive legal norm about kitchen waste management, which is obviously not accord with our mainline- to construct rule by law country and socialist legal system as well as forbidden by system of socialist laws with Chinese character. On the contrary, many foreign countries like U.S., Japan, Korean and so on has established the laws and regulations about kitchen waste management. Furthermore, some of them have formed impeccable law system about the issue. With the deepened harm of kitchen waste to the social life, the lag implement of the related laws and regulations is one of the most important reasons. At present, laws and regulations related to the kitchen waste in our country are just referred in several articles in the law of solid waste prevention and control of environmental pollution of the People’s Republic of China and some local legislation and regulations such as Shanghai, Xining and so on. There once emerged a legislating upsurge about kitchen waste management in some local areas, and Shanghai even obtained high level legislation, furthermore, Xining set some legislation standards about kitchen waste management through the NPC form. All those are undoubtedly setting a good example for the domestic kitchen waste management legislation and gather experience for our establishing united and comprehensive kitchen waste management legislation. However, we have to face up to a severe fact that our country’s legislation about kitchen waste management is just remained on the local level, and there are lots of problem in the local legislation about the kitchen waste management need to be solved, for example, undefined conceptions, imperfect system and obscure enforcement subject of law and so on, which seriously influent the implement of the law and people’s daily lives. Therefore, under these conditions, the hope of setting up a united and comprehensive kitchen waste management legal norm is stronger and stronger.
