Abstract


The recent academic publications on legal discourse translation center on the micro-linguistic level of its linguistic properties and legal translation is only deemed as a process of linguistic trans-coding. In consideration of this, the present study, based on Bourdieu’cultural production theory, explores the social factors that make legal discourse what it appears with the application of his core concepts of field, capital, habitus, symbolic power and power justification; and probes the symbolic power of legal discourse and its translation. Power, taking the form of symbolism rather than violence, slips into people’s habitus and directs their social practice, in which it is acknowledged and achieves self-legitimation and justification. Language strategies and power strategies interrelate with each other, and institutionalized discourse is the embodiment of the symbolism of power. Legal discourse, one form of institutionalized discourses with its own characteristics, is an embodiment of the symbolic power as well as an effective strategy for power justification. The thesis, taking the Compulsory Education Law of the People’s Republic of China as a case, explores the symbolic power of legal discourse, analyzes the particular linguistic features reflecting the power, and suggests correspondent translation strategy.The paper, combining macroscopic and microcosmic methods, probes legal discourse translation from the angle of sociology, which opens up a new theoretical research perspective for legal discourse translation, and brings inspiration to legal translators.
