Criminal Evidence System is an important part of the system , and the rules of evidence is the core of the system of criminal evidence . The soundness of the rules of evidence reflects a national litigation system is democracy, rule of law, an important indicator of the degree . China has successively appeared \Researchers generally believe that the law led to China's Criminal root causes of miscarriage emerging illegal evidence. In order to contain and prevent the occurrence of miscarriages of justice , reshaping judicial authority , June 13, 2010 , by the Supreme Court , Zuigao Jian , Ministry of Public Security and other departments jointly issued the \and \as the arrest, prosecution and conviction of evidence . \Because of its crime prevention and the protection of human rights , in line with the requirements of the rule of law society , to achieve procedural justice, and regulate law enforcement behavior of the value and function of the body , so we have the legal level and resolutely implement aspects of legal affairs . This article attempts to first from the definition of illegal evidence and the exclusionary rule definition begins to explain the exclusionary rule connotation and litigation value and functionality . On this basis , the elaboration and analysis of foreign exclusionary rule generation and development. In a comprehensive study and analysis of foreign exclusionary rule applies in the case , combined with the right of non-normal deaths and miscarriages of justice detention center frequency of the analysis, improve and perfect suitable for China 's exclusionary rule some of the ideas .
