Abstract

Private finance for outstanding contributions to China's economic development , good to make a formal financial deficiencies , and promote the development of the private economy . However long time, China has been the lack of private finance and specialized legal regulations to be regulated and guided , private financial activities also had a huge risk , largely affected the stability of financial markets . Therefore, the private financial activities have been subject to government repression. Inhibition of the current financial situation, not only unhelpful role of financial deepening , financial development role in promoting economic development , but also in the long-term private finance is largely forced \China asked the finance where to go, how it should be regulated , become an urgent reality. In this paper, China's economic and financial analysis of the reality of the start, is divided into four parts argument. The first chapter discusses the rationality of existence of private finance and the financial status of the development of civil society ; perfect folk from the second chapter the theoretical basis of the financial regulatory system , discusses the need for private financial regulatory law ; chapter on private financial regulation legal system analyzes the current situation , China's legal system , although not exclusively on private financial regulation, but the attitude of private finance is very clear, that the strict control ; fourth chapter describes the legal system of private finance to build the basic regulation ideas and specific measures. Allow private finance into the financial markets fair competition and free trade , while strengthening supervision to prevent their entire financial order and national economic security damage . On the basis of the above chapters , come to this conclusion: China should improve folk in financial regulation legislation, through the establishment of private financial institutions , based on the private financial regularization ; regularization of private finance after deregulation , strengthen supervision the basic principle, according to its characteristics , build specifically for civil legal system of financial supervision .
