Abstract

To achieve maximum efficiency of land during the market economy periods, it’s generally requested to deploy the land resources through the market mechanism. It’s a major issue of public policy and management in our country to speed up the marketization of the right of using rural land. We’re required to innovate the land legal system. Firstly, we need to combine the protection of cultivated land with the need for industrialization and urbanization land; secondly, we should combine improving land use efficiency with maintaining the interests of farmers. Therefore, to achieve the marketization of the right of using rural land is a matter of rural development and it’s relevant to the interests of most people. It’s of great theoretical and practical significance to study the efficient and reasonable collocation methods of land resources.This thesis adheres to the basic principle of combination of theory and practice and systematically discusses China’s rural land system reform in the framework of law by means of from the abstract to the concrete and combination of historical analysis and real analysis.It’s the most realistic choice to adhere to the existing institutional framework of rural land reform. It not only points out the directions for rural land reform, but also helps reduce the cost of rural land reform. Rural land contracting management is still the best choice. To propel the reform of rural land law, it[s necessary to accurately define the main streamline land property rights, establish more stringent implementation of the land registration system and the gradual standardization of the cadastral management. In the reform of rural land system, we should further promote the long-term rural land use right of farmers and perfect the contents. To establish and improve the land use rights transfer system is to improve the transfer of land ownership laws and regulations, establish guidelines for rural land market and rural land prices in the market mechanism, village committees and other bodies to play the role of organizational resources. Land for land reform should be instructed by the socialist market economic system as to protect the legitimate interests of farmers’ land property rights. The interests of the state, collectives and farmers should be taken into account while carrying out the land acquisition system reform. The informal reform of the system will have an great impact on the values and behaviors of the farmers. We should take appropriate means to promote the change of old ideas and make it become the driving force of economic development.
