Abstract


Arbitration is an important international commercial activities of dispute resolution . Signed in New York in 1958 , the Recognition and Enforcement of Foreign Arbitral Awards Convention (hereinafter referred to as the \China in 1986 and joined the New York Convention \This article first analyzes the recognition and enforcement of foreign arbitral awards , production, research and analysis of Foreign Arbitral Awards recognized standards and the legal basis for the Recognition and Enforcement of Foreign Arbitral Awards . On this basis , focusing on the New York Convention provides refuse recognition and enforcement of foreign arbitral awards four cases were analyzed , are parties incapacitated and the arbitration agreement is invalid , violation of due process of law , an arbitral award beyond the arbitration agreement agreed the scope and contrary to public policy . Paper adopts the way of empirical analysis , analyze and summarize the Supreme People's Court announced the recognition and enforcement of Foreign Arbitral Awards, the typical case , and then try the Chinese courts in the New York Convention on Foreign Arbitral Awards in the monitoring and review process approach to initial induction, and problems solution .
