Abstract


This paper, under the framework of WTO Subsidies and Countervailing legal system , a systematic exposition of the basic theory and the main legal issues of the WTO Subsidies and Countervailing rules , and learn from Western developed countries, legislation and practice relevant theory argument , aimed at resolving the country countervailing legislation and the problems encountered in practice . Introduction, body and conclusion of the paper is divided into three parts , the body constituted by the four chapters . The introductory remarks mainly on the topics of the background , the significance of the study , the thesis research methods as well as the characteristics of the paper . Chapter 1 is an overview of its system of subsidies and countervailing History . This chapter provides an overview of the concept of subsidies and countervailing characteristics reveal the root causes of the Subsidies and Countervailing and introduced subsidies and countervailing rules under the WTO framework and evolution of the Western developed countries countervailing duty laws . Chapter 2 of Western developed countries on Subsidies and Countervailing legislative practice . Chapter four of this analysis are special orientation judgment interest standard of judgment , legal issues determine the damage and the causal relationship between the subsidy and damage issues . Chapter 3 analysis of the provisions of the relevant provisions of the WTO framework on Subsidies and Countervailing . This chapter is divided into three sections , the first section to explore the framework of the WTO under the four important issues as well as issues of special and differential treatment for developing countries , revealing the way the international community to deal with the problem in practice ; Section II of subsidies under the WTO framework explained under the framework of WTO subsidies and Countervailing Measures Agreement and the differences between the Western developed countries domestic countervailing duty and Countervailing content is reviewed to clarify its strengths and weaknesses ; comparative analysis of the third quarter . Chapter 4 is to explore how to create a the countervailing legal system suited to China's national conditions . Countervailing legislative status quo of China 's first , and then analysis of current legislation and the SCM Agreement, the gap between the Western developed countries , and finally explore the improvement of China countervailing legislation , and put forward some feasible suggestions and opinions . The conclusion summarized the WTO subsidies and countervailing rules and legislative practice of Western developed countries , combined with the latest trends of the Subsidies and Countervailing problem , to summarize our countervailing legislation and practice .
