Abstract


Our country’s financial transfer payment system has constantly improved from based, and acquired some achievements. However, influenced by police in old system and lacked of defining scientific government functions, our current financial transfer payment system still exists many problems, has already not adapt the development of socialism market economy and the need of establishing of socialism commonality finance system. Compulsory education as a public product which has double externalities makes the compulsory education financial transfer payment is very important in the financial transfer payment system. As the different development of economy in China , the central financial transfer payment to every province is not the same, which makes the compulsory education financial transfer payment to the localities is not equal. There is a long way to go for the poor west area to catch on the east area. The government solved the problem of the development difference of compulsory education among the localities with the legal system of compulsory education financial transfer payment. Now the legal system of compulsory education financial transfer payment in China has many problems, such as the lack of legal system and supervision which makes so much money of the transfer payment is not to be used for the compulsory education. So the equal development to every district is impossible.Through the introduction of the related case and the theory of financial transfer payment, this paper explained the present conditions and problems of legal system of compulsory education financial transfer payment: Among governments at all levels is not clear division of responsibilities; Compulsory education in the financial transfer payment of funds allocated to the lack of statutory standards of scientific and effective, Compulsory education in the financial transfer payment of funds allocated to program the lack of legal regulation and supervision and so on. The developed countries such as America and Japan, have many advanced experienced and many common characteristics, which have values for our country: Compulsory education between the two countries to take the separation of powers provided at the same time, higher levels of government are provided for compulsory education of local government financial transfer payment and transfer payments are a large scale; Compulsory education at the financial transfer payment on the division of responsibilities between the two countries central or federal government and local governments have a clear division of labor; Compulsory education for different financial transfer payment policy objectives, both select the most appropriate form of financial transfer payment; Compulsory education between the two countries the largest financial transfer payment system is the common formulation, the rule of law and standardized. Based on this, the theory mentioned some suggestions for the improvement of the legal system of compulsory education financial transfer payment: Strengthen legislation, Improve relevant laws and regulations; clear the main financial transfer payment of compulsory education and its division of responsibilities; the establishment of compulsory education in the financial transfer payment of statutory procedures; strengthening the financial transfer payment compulsory legal supervision.The purpose of studying legal system of compulsory education financial transfer payment is to solve the problems we meet with in the practice of compulsory education financial transfer payment and the writer wants more and more researchers in the legal field to pay attention to this issue and take part in the study on legal system of compulsory education financial transfer payment. Therefore, the realistic meaning and theory valve of this study can be promoted extremely.
