Abstract

Crime of Swindling as a regular and traditional property crime ,With the continuous development of China’s private economy and science and technology, Its new forms of crime are emerging. In order to estimate crime of swindling more accurately, and to punish it fully, it is necessary to amend the traditional theory of the object of crime and rethink the status and function of target of crime of swindling.This article is divided into four chapters, as follows:The fisrt chapter is an overview of the theoretical system of the object of crime of swindling. As the basis of Researching the object of crime of Swindling, first of all,discuss the the basic theory of object of crime, including the concept of the object, the crime classification and system and status of the target of crime, and then introduce the theory of object of crime and explain the influence that the "legal interest theory"over the theory of object of crime.The second chapter is a reconstruction of the object of crime . Section 1 analysis on the deficiency and Challege of the theory of proprietorship. Section 2 analysis on Rationality of Possession thoery and point that the Possession thoery accord with the development of the object of crime.The third chapter analyzes the target of crime in Crime of Swindling. Section 1 focus on an analysis of the classification of the target of crime in Crime of Swindling.In section 2 analyzes the Relationship between the object and the target of crime in Crime of Swindling. In section 3 specific examples were analyzed.
