Abstract


For a long time, people's understanding of marriage is based on combining the sexes. Naturally this combination has become a kind of potential rules, is the same. In the face of the gay marriage right to appeal, this rule showed a strong fighting spirit. However, as the gay rights movement for the emancipation and development of the human rights campaign, the change in people's attitudes towards gay men, in some countries and regions, between gay marriage is protected by the law, but also can enjoy in marriage and family rights. Gay marriage as appeared in the process of human social development of a new kind of legal phenomenon, in the international judicial practice has produced some of the conflict of laws problem, at the same time, it caused the wide attention of scholars in various fields. In this paper, through historical, comparative and method of sociological research methods and with some thinking concept of postmodern jurisprudence on same-sex marriage legislative mode comparison and analysis, summarized the current development of international community on same-sex marriage legislative mode, and against same-sex marriage legislation in all countries in the judicial practice caused by the problem of private international law analysis, put forward feasible Suggestions in our country currently deal with same-sex marriage.
