Abstract


Zhaoxing restorative justice in the West means by professionals or community members act as a neutral third party under the auspices of the offender and the victim , face to face consultations and to identify solutions to an apology by the perpetrator , financial compensation , community service, and other ways of life to help the victims of crime caused due to physical, mental damage compensation , but also to make the offender to regain the victims , their families and community members understanding reintegration into the community of a crime approach. Restorative justice is its emphasis on the social relations of crime undermine the maintenance and reconstruction of the unique advantages have been recognized by many Western countries , restorative justice programs to be implemented in a large number of Western countries . Advanced western restorative justice , China's mediation system deficiencies have become more apparent, such as the mediation of criminal prosecution cases exhibit irreconcilable , institutional lag , civil mediation practice and philosophy demonstrated disjointed , lack of party -led philosophy, administrative mediation demonstrated the concept of administrative mediation lag and system availability and so on. Therefore , I believe that the introduction of restorative justice mediation system is necessary, but also feasible , because restorative justice and mediation system in our country , there are many traditional fit place , for example: to restore harmonious society stressed relations , have stressed the application of mediation means and so on. However, the introduction of restorative justice mediation system in our country is not the way I think is flat , there is China's traditional mediation system and restorative justice fit place constraints also exist factors such as : the traditional concept of the \pursuit, \I believe that: Only our rational view of restorative justice in the premise, while focusing on combining national conditions , people, social conditions , and fully absorb the restorative justice among the concept of rational core , the conversion of traditional mediation concept , perfect restorative justice are appropriate procedures and systems required , the only way to make it better for the country's mediation system services.
