Abstract


Criminal reconciliation mode of Western society in the restorative justice philosophy nurtured a criminal case to solve . The idea in the restorative justice concept of penalty . The emergence of criminal reconciliation system , a whole new program to solve criminal cases . Of the judiciary in recent years, criminal reconciliation system actively explored . This paper first examines the concept and value of the Criminal Reconciliation System , expounded the theoretical basis of the criminal reconciliation system development process from the concept of restorative justice . This article also the rise in China 's judicial practice of criminal reconciliation system described and analyzed . This paper argues that the rise of criminal reconciliation system times the background , at the same time the criminal reconciliation system fit the Chinese tradition , resources , institutional and policy foundation , so you can run under the existing judicial system . This article focuses examine the prosecution phase of criminal reconciliation in the practice of criminal reconciliation system are summarized in the phase of the Scope and application . Confusion encountered in the practice of criminal reconciliation analysis , and trying to find the road to solve the problem .
