Abstract


Civil Retrial System is extremely important to the legal system of a country in the field of civil justice . This system is built on the concept which has what kind of content and composition , is closely related with the basic principle of the entire litigation trial system . Civil Retrial System in China is drawing on the system on the basis of the former Soviet Union litigation , and by the cultural influence of traditional Chinese method . The system to \the referee final adjudication between the the referee request tension and conflict between the rights and the trial of the terms of reference . The enormous destruction of our the retrial system of judicial finality and authority endanger the whole community has confidence in the administration of justice , fundamentally undermine the legitimacy of the administration of justice , to form a factor affecting China 's social and political stability and economic order . This paper first describes the the retrial system concept and function , to study the relevant provisions of the civil law countries, civil retrial procedure of retrial procedure , and then discuss how to learn from foreign advanced concepts and advanced experience . Expounded the major achievements of the civil retrial procedure amendment . Analyze the main problems of the amendments to the Civil Retrial Procedure . Finally, discussed in full retrial for further improvement of the Reform .
